Article written by Maurizio Iorio , attorney at law , published on the issue of July- August 2013 of the magazine MP – Market Place ( Consumer Electronics ) – Synopsis : in the article are examined the main rules of the legal business-to-business guarantee , namely that form of guarantee binding the supplier towards the purchaser (company, professional entity, self-employed etc.), when the object of the supply is a service or product not intended for resale to final consumers ; it should be emphasised that in the case of supply by way of contract work , following the amendments introduced by the Law Decree 69/2013 (“Decree of doing”) enacted with the Law 98/2013 (published in the Official Gazette of 20 Aug 2013), the Customer is required to ascertain that only the payment of withholding taxes on income from employment has been made by the contractor to the tax authorities, in no longer being required to ascertain that in relation to VAT .
